ORDINANCE
AMENDMENT TO THE
For
the purposes of this Ordinance, the following definitions are adopted:
Section 300.14(a) of the Ordinance is
amended as follows:
300.14 "Designated Floodway" The channel, including on-stream lakes, and
that portion of the floodplain adjacent to a stream or watercourse as
designated by IDNR/OWR, which is needed to store and convey the existing 100-year
frequency flood discharge with no more than a 0.1 foot increase in stage due to
the loss of flood conveyance or storage, and no more than a 10 percent increase
in velocities.
(a) The floodways are designated on the countywide Flood Insurance
Rate Map for Cook County number 17031C, panels 167, 169, 188, 307, 308, 309
and 330 dated February 4, 2004, panels 142, 144, 155, 161, 163 and 305 dated
December 20, 2002, and panels 20-113, 156-159, 162, 164, 166, 168, 176-187,
189-270 and 331-832 dated November 6, 2000 prepared by FEMA.
Section 300.26(a) of the Ordinance is
amended as follows:
300.26 "Floodplain"
That land typically adjacent to a body of water with ground surface
elevations at or below the base flood or the 100-year frequency flood
elevation. Floodplains may also include
detached Special Flood Hazard Areas, ponding areas, etc. The floodplain is also known as the Special
Flood Hazard Area (SFHA).
(a) The floodplains are those lands within the jurisdiction of the
County that are subject to inundation by the base flood or 100-year frequency
flood. The SFHA's of the County are
generally identified on the countywide Flood Insurance Rate Map for Cook County
number 17031C prepared by the Federal Emergency Management Agency, panels
167, 169, 188, 307, 308, 309 and 330 dated February 4, 2004, panels 142, 144,
155, 161, 163, and 305 dated December 20, 2002, and panels 20-113, 156-159,
162, 164, 166, 168, 176-187, 189-270 and 331-832 dated November 6, 2000.

ORDINANCE
AN ORDINANCE GRANTING A SPECIAL USE FOR UNIQUE USE
LOCATED IN
BY THE
WHEREAS, the owner of
certain property located in Riverside Township described in Section 1, herein,
has petitioned the Cook County Board of Commissioners for a Special Use for
Unique Use and a Variation permit in the R-5 Single Family Residence District
for rental of an existing coach house, and a Variation to reduce distance
between principal and accessory structure from 10 ft. to 8.5 ft. (existing),
and reduce left interior side yard setback from 10 ft. to 3 ft. (existing);
reduce right corner side yard setback from 15 ft. to 4 ft. (existing), and
reduce rear yard setback from 10 ft. to 2 ft. (existing), and
WHEREAS, the said petition
was received by the Zoning Board of Appeals of Cook County as Dockets #7504
& #7470 and a public hearing was held in regard to said request after due
notice, all in accordance with the Cook County Zoning Ordinance and the
Statutes of the State of Illinois, and
WHEREAS, the Zoning Board of
Appeals entered detailed findings in accordance with the standards set forth in
the Ordinance recommending that the Cook County Board of Commissioners grant
said applications for a Special Use for Unique Use and Variation permit, and
WHEREAS, it is the
determination that said request be granted in accordance with the
recommendations of the Zoning Board of Appeals.
NOW, THEREFORE, BE IT ORDAINED
by the Board of Commissioners of
Section 1: That a Special Use for Unique Use for rental of an existing
coach house, and a Variation in the R-5 Single Family Residence District is
hereby authorized as set forth in the Findings and Recommendations of the
Zoning Board of Appeals.
LEGAL DESCRIPTION
Lots 11, 12 & 13 in Block 6,
in Riverside Lawn, a subdivision of part of the SW 1/4 of Sec. 36, T39N, R12,
E. of the 3rd Principal Meridian, lying East of the West 10 chains thereof and
East and South of the Des Plaines River, in Cook County, Illinois.
commonly described as approximately 0.21 acre, located on
the Northwest corner of
Section 2: That the Special Use for Unique Use and Variation located in
the R-5 Single Family Residence District is hereby authorized.
Section 3: That this Ordinance under the provisions of Section 13.8.9,
9.9.8 and 13.6.3 of the County Zoning Ordinance be in full force and effect
from and after its passage and approval, except that if said use is not
established within one year as provided in the above referenced Sections, said
Special Use for Unique Use and Variation shall be null and void.
That said property be developed
and constructed pursuant to the detailing set forth in the testimony and
contained in the exhibits and Findings of the Cook County Zoning Board of
Appeals hereby incorporated by reference into this Ordinance, as provided by
law.
