This grant, made available through the Federal Anti-Drug Abuse Act, will fund gender-responsive treatment and aftercare services to adult female offenders sentenced to probation or supervision for substance abuse-related offenses.
This program will enhance services for female offenders making the transition from custody under the Sheriff’s Department for Women’s Justice Services to supervision under the court’s Adult Probation Department. Services provided will include drug assessment detoxification services, counseling and life skills development. The program relies on interagency collaboration and continuum of services to break the cycle of addiction and crime and facilitate successful reintegration back into the community. The program outcomes will be measured in compliance with the Adult Probation Department’s comprehensive evaluation protocols.

This grant is funded through the State Court Improvement Program (CIP) and will fully fund an independent evaluation of the Child Protection Mediation Program by the Center for Analysis of Alternative Dispute Resolution Systems (CAADRS). The independent evaluation by CAADRS will assess the program’s progress and effectiveness.
The court’s Child Protection Mediation Program was initiated in February 2001 to increase the court’s ability to make more informed decisions concerning safety, visitation, family reunification and permanency. The program uses a model that provides for participation by attorneys, case managers, foster parents, family members, and other individuals involved with the family.

The one (1) full-time child sexual abuse specialist funded by this grant focuses on providing victim services including crisis intervention with victims and families of victims, identifying and making referrals for immediate and long-term counseling services, monitoring and coordinating services for children who are wards of the state and working with the local and state agencies involved with the victim as well as working directly with local and state law enforcement and service agencies to provide training, technical assistance and consultation.
The estimated fiscal impact is the remaining salary and fringe benefits of the child sexual abuse specialist that would not be covered by the anticipated grant awards from the Illinois Attorney General’s Office and the Department of Children and Family Services.

Program. The program funds three (3)
delinquency courtroom specialists and one (1) transfer specialist who work in
the Victim Assistance Program at Juvenile Court.
This grant requires that the office match 25% of the grant
award. The match contribution for this
program is both an in-kind match as well as a cash match. The in-kind match fully supports the salary
and fringe benefits of one (1) of the juvenile court victim specialists. Due to increasing hospitalization and other
fringe benefit costs, the current grant award received by the office does not
cover the full fringe benefit costs of the three (3) federally-funded juvenile
court specialists. The $28,787.00 in
cash matching funding will support the remaining hospitalization costs of the
three (3) federally-funded juvenile court specialists.

Partnerships Program Loan in the amount of $1,650,000.00. The loan will be to a limited partnership to
be formed by a wholly owned subsidiary of the Cook County Housing Development
Corporation and an affiliate of DKI, Inc. controlled by Daniel S. Kotcher,
together, with the low income housing tax creditor syndicator. The loan will be for the construction of a 60
unit (54 HOME assisted units), affordable, rental, senior independent, housing
facility to be located at Sauk Trail and Butterfield Drive in Richton
Park. In addition to the HOME funds,
other funding will include a private first mortgage, third mortgage through the
Illinois Housing Development Authority’s (IHDA) Trust Fund Program, equity
raised through the sale of Low Income Housing Tax Credits, a Federal Home Loan
grant, general partner equity and deferred developer fees. DKI, Inc. will donate the land to the project
as part of the Illinois State Donation Tax Credit Program. The development budget is estimated at $8,754,622.00
of which $1,650,000.00 accounts for approximately 19% of the total project
costs.
The terms of the HOME Program loan will be structured as a
40-year fully amortized loan at 1% interest.
The County HOME program will receive monthly principal and interest
payments of $4,172.12 with an annual payment totaling $50,065.50 to be used for
other HOME eligible activities.

AMENDMENTS TO THE LONGTIME HOMEOWNER
EXEMPTION ORDINANCE
WHEREAS,
WHEREAS, many
longtime homeowners in gentrifying areas face the threat of being forced to
sell their property due to the exponential increase of their property taxes;
and
WHEREAS, in
recognition of the severe economic circumstances many longtime homeowners have
faced, the Illinois Legislature passed Public Act 88-451, the Longtime
Owner-Occupant Tax Relief Act (35 ILCS 250, et. Seq.), in August, 1993; and
WHEREAS, on July 24, 1998, the Illinois
Legislature passed Public Act 90-0648, amending the Longtime Owner-Occupant
Property Tax Relief Act to require the participation of the City of Chicago and
the Board of Education; and
WHEREAS, on
WHEREAS, counties,
having a population of 100,000 or more, are authorized to enact an ordinance,
in accordance with the provisions of the Act, that provides for property tax
relief; and
WHEREAS, pursuant
to the Act, as a county with a population of more than 100,000, Cook County is
authorized to enact an ordinance to provide tax relief to longtime homeowners
within the County that may be eligible under the provisions set forth in the
Act; and
WHEREAS, as a
matter of public policy, the Cook County Board of Commissioners has the
authority and responsibility to enact property tax relief provisions that will
enable eligible longtime homeowners to remain in financially secure possession
of their homes.
NOW, THEREFORE, BE IT
ORDAINED, by the President and the Board of Commissioners of Cook County
the following:
TITLE OF
ORDINANCE: Amendment to the Longtime
Homeowner Exemption Ordinance. The
Ordinance, adopted
An Ordinance creating the Homeowner Exemption for Long-term
Properties (“H.E.L.P.”) Program to provide property tax relief to certain
longtime homeowners in established neighborhoods, who are facing a dramatic
rise in property taxes directly or indirectly attributable to
gentrification. To be eligible, the
longtime homeowner must own and reside in a Cook County Class 2 property for a
minimum of ten years, or five years if the homeowner received assistance in the
acquisition of property as part of a government or non-profit housing
program. The Assessor shall verify
potential eligible homeowners on an annual basis according to the eligibility
criteria of the act and provide to the Cook County Clerk the information
necessary to calculate the exemption in accordance with the provisions set
forth in this Ordinance. The Cook County
Clerk shall then remove the exempt value from the calculation of the property
tax and the Cook County Treasurer shall state on the tax bill the amount of the
tax saved by the exemption.
SECTION 1. SHORT
TITLE. This Ordinance shall be known and may be known and citied as
“Longtime Homeowner Exemption Ordinance.”
SECTION 2. PURPOSE. The intent of this Ordinance is to stabilize
the effects of soaring property taxes for longtime homeowners who otherwise may
be displaced from neighborhoods where gentrification is occurring.

SECTION 3. DEFINITIONS.
As used in this Ordinance:
“Assessment
District.”
“AV.” Assessed Value as defined in the Cook
County Real Property Assessment Classification Ordinance (Section 2, Class 2
and Section 3, Class 2).
“Fair Market Value”
(FMV). The value the Cook County Assessor places on each parcel of real
estate.
“Market Value.” The
amount a property could sell for on the open market.
“Average Assessment Increase.” A percentage calculated by taking the value of all potentially qualifying Class 2 properties within the assessment district and determining the percent difference between the current reassessment value and the prior year’s assessment value.
“EAV.” Equalized Assessed Value. The assessed value multiplied by the
equalization factor calculated by the Illinois Department of Revenue.
“H.E.L.P.” Homeowner Exemption for Long-term Properties calculated
as follows: that portion of the current
EAV for an eligible property which exceeds the sum of: (1) EAV for the year prior to reassessment;
plus (2) prior year EAV multiplied by a factor equal to 150% of the average
assessment increase for the most current reassessment of the assessment
district.
“Class 2
Properties.” Residential properties
as defined in the Cook County Real Property Assessment Ordinance (Section 2,
Class 2).
“Longtime
Homeowners.” Persons who have owned
and occupied a Cook County Class 2 property for ten years or more as their
principal residence, or five years or more if the owner received assistance in
the acquisition of the property as part of a government or non-profit housing
program. “Longtime homeowners” also
means persons who inherited the property from a spouse who owned and occupied a
Class 2 property for ten years or more as their principal residence or five
years or more if the owner received assistance in purchasing the residence from
a government or non-profit housing program.
“Triennial
Reassessment.” Any reassessment of
an assessment district, which occurs every third year as set forth in the
Illinois Property Tax Code (35ILCS 200/9-220(B)).
SECTION 4. ADMINISTRATION OF THE SAVE OUR HOMES TAX
RELIEF PROGRAM.
(A) The Cook County Assessor shall have the authority to.
(1) Administer
the Homeowner Exemption for Long-term Properties (“H.E.L.P.”) program as
created by the enactment of this Ordinance and the amendment of this
Ordinance and determine those homeowners eligible for the Longtime
Homeowners Exemption and apply the exemption on behalf of the eligible
homeowners, transmitting all appropriate information to the

applications for and determine potentially to end the program based on
eligibility criteria set forth in this Ordinance and:
(B) The Cook County Clerk shall have the authority to
compute tax rates and calculate tax bill amounts and to provide this
information to the Cook County Treasurer to implement the provisions of this
Ordinance.
(C) The Cook County Treasurer shall state on the tax bill
the amount saved by the tax relief program.
SECTION 5. ELIGIBILITY CRITERIA.
The following criteria shall be used to verify a longtime
homeowner’s eligibility for the H.E.L.P program on an annual basis:

1) Homeowner is an owner-occupant of a Cook County Class 2 property, and that property has been the homeowner’s principal residence for at least ten consecutive years as of January 1 of the reassessment year. A homeowner may become eligible for an exemption in a year subsequent to reassessment if a ten year consecutive residency has been established by January 1 of that year; or
2)
Homeowner is an owner-occupant of a Cook County Class 2
property, and that property has been the homeowner’s principal residence for at
least five consecutive years, if the homeowner received assistance in the
acquisition of the property as part of a government or non-profit housing
program under the following guidelines:
a. The program is restricted to qualified
homebuyers on the basis of the household income of the homebuyer; and
b. The income restriction for the homebuyer did
not exceed 120% of the area median income as defined by the U.S. Department of
Housing and Urban Development; and
c. The subsidy exceeds $5,000 or 5% of the
development cost of the property, whichever is greater; and
d. The homebuyer is restricted from selling the
house at full market price for at least five years from the date of purchase.
e. The Cook County Board shall determine whether
a purchase assistance program is qualified under the provisions of this
Ordinance; and
3)
Homeowner’s property must have an AV increase that
exceeds 150% 115% of the current average AV increase for Class 2
properties in the assessment district where the property is located and a Fair
Market Value (FMV) below $500,000; and
4)
Homeowner’s annual household income for the year
of the homeowner’s triennial assessment does not exceed one hundred and fifteen
percent (115%) of the Chicago Primary Metropolitan Statistical Area median
income as defined by the United States Department of Housing and Urban
Development; and
5)For
any triennial assessment cycle, homeowner did not cause a substantial
improvement, which resulted in an increase of fair cash value in the property
in excess of the $45,000 allowance as set forth in the Illinois Property Tax
Code (35 ILCS 200/15-180).
SECTION 6. APPLYING THE
EXEMPTION.
(A) The
Cook County Assessor shall:
(1)
Annually verify potential eligible homeowners;
and
(2)
Provide to the Cook County Clerk the information
necessary to calculate the exemption in accordance with the Ordinance.
(B) The
Cook County Clerk shall remove the exempt value from the calculation of the
property tax.
(C) The
Cook County Treasurer shall state on the tax bill the amount of tax saved by
the exemption.
SECTION 7. ELIGIBILITY
NOTIFICATION.
The Assessor shall notify
potentially eligible owners of record of Class 2 properties in Cook
County of the
existence of the Longtime Homeowners Exemption Program for each triennial
assessment cycle within sufficient time to apply.
SECTION 8 7. APPLICATION.
This Amended Ordinance shall first
apply to the assessment district of the 2002 2003 tax year and to each
assessment district thereafter.
SECTION 9 8. REQUIREMENTS
FOR DETERMINATION OF PARTICIPATION.
Any taxing agency exercising the
provision(s) in the Amended Longtime Owner-Occupant Property Tax Relief Act (35
ILCS 250, et seq.) shall:

(1) File a resolution or ordinance with the Cook County Clerk no later than the last Tuesday in December of the year for which the taxes are assessed; and
(2)
In any event that any taxing agency adopts eligibility
standards or criteria which differ from those provided herein at Section 5, the
taxing agency shall certify a list of parcels (Permanent Index Numbers) deemed
eligible by the taxing agency to the Cook County Assessor no later than the
last Tuesday in December of the year for which the taxes are assessed.
SECTION 10 9. EFFECTIVE
DATE.

Amendment to Cook
WHEREAS, the
ordinance establishing the Cook County Board of Commissioners as the Cook
County Board of Health and establishing the Cook County Board of Commissioners
as the Cook County Board of Health and establishing the Cook County Department
of Public Health was originally passed in 1943; and
WHEREAS, the Cook County Department of Public Health
serves all areas of Cook County except those served by a health department certified
by the Illinois Department of Public Health and also performs functions in
areas throughout Cook County to the extent such functions are delegated to the
Cook County Department of Public Health by the Illinois Department of Public
Health; and
WHEREAS, Chicago, Evanston, Oak Park and Skokie, as
well as Stickney Township, are currently served by health departments certified
by the Illinois Department of Public Health; and
WHEREAS, revisions
to this ordinance are needed to update references to State law which have
changed since the Ordinance was initially adopted; and

WHEREAS, revisions
are also needed to better protect the residents of Cook County from new and
emerging public health threats, such as Severe Acute Respiratory Syndrome (SARS);
and
WHEREAS, the
appearance of SARS and heightened concerns about the responses required by
local health authorities to potential bioterrorism have resulted in the need to
review the local, state and federal provisions; and
WHEREAS, the United
States Centers of for Disease Control and Prevention
(CDC) requested that all local health departments have in place SARS plans
which include procedures for the rapid and effective implementation of measures
such as quarantine, isolation of closures of premises as required for the
protective of the public’s health; and
WHEREAS, the
proposed revisions provide clearer guidance and authority to the Cook County
Department of Public Health with regard to immediate public health measures including
the issuance of emergency regulations and including provisions for Board
approval of Department regulations; and
WHEREAS, the
proposed revisions balance the need to protect the public with the need to
provide due process to individuals who have or who may have been exposed to,
dangerously communicable diseases.

Cook County Department of Public Health (“Department”) was established
pursuant to provisions of the Act entitled “An Act in relation to the
establishment and maintenance of county and multiple-county public health
department,” approved July 9, 1943, as amended.

Board of Commissioners as Board of Health
5-201. For the purpose of the operation and
maintenance of the said Cook County Department of Public Health, the
Board of Commissioners of Cook County does hereby organized and
constituted itself as the Board of Health of Cook County for the purpose
of carrying out the provisions of the said Act in a manner similar to other
acts and duties of the County. The
President of the Board of Commissioners of Cook County is hereby designated and
constituted the President of the Board of Health of Cook County. The Secretary of the Board of Health of
Cook County shall be such member of the Board of Health as shall be elected by
the Board. The Clerk of the Board of
Commissioners of Cook County is hereby designated and constituted Assistant
Secretary of the Board of Health of Cook County. Except as otherwise provided, all
references to the “Board” shall refer to the Board of Commissioners of
5-202. It is the mission
and policy of this Board to protect and promote the health of the people of
Jurisdiction
5-2032. The
Board of Health Board and the Department shall have jurisdiction
throughout the County of Cook entire county except within any
city, village, or incorporated town, or combination thereof, which is
maintaining a full time health department certified as defined
by the Illinois Department of Public Health.
The Board and Department may have additional jurisdiction when acting
pursuant to a specific delegation of responsibilities by the Illinois Department
of Public Health.
Board Powers and Duties
5-2034.
Within its
jurisdiction the Board of Health Board of Cook County
shall exercise such powers and perform such duties as are granted unto it pursuant
to by the statutes in the case made and provided and as are not
inconsistent with the provisions of applicable statutes, applicable
regulations of the Illinois Department of Public Health, and this Ordinance,
including Rules and Regulations adopted pursuant hereto.

5-2045. Organization
of the Department. Board
of Health of Cook County Upon the recommendation of the Chief of
Health Services, tThe The President and Members of the
Board Board of Health of Cook County shall,: subject to
the rules and regulations of the Cook County Human Resources Ordinance and upon
the recommendation of the Chief of Health Services, except absence of such
recommendation shall not prevent the Board of Health from acting with respect
to these powers:.
1. Appoint a
Chief Executive Officer as the Cchief Ooperating Oofficer
for the Department. The Chief Executive Officer shall be qualified as
either a Public Health Administrator or as a Medical Health Officer and shall
possess such qualifications as may be prescribed by the State Department of
Public Health, and who shall have the powers hereinafter provided;
2. Appoint
such other professional employees including, but not limited to, licensed
physicians, who shall possess such qualifications as may be prescribed by the
State Department of Public Health for their respective positions;
3. Appoint such
other officers and employees as may be necessary;
4. Prescribe the
powers and duties of all officers and employees, fix their compensation and
authorize payment of the same and all other Department expenses from the County
Health Fund, in accord with adopted budget for the Cook County Bureau of
Health Services;

5. Provide that
all employees of the Public Health Unit of the Cook County Bureau of Public
Welfare, as established on

Chief of Health Services shall submit recommendations to the President and the
Board with respect to the items set forth in this Section.
Department Powers and Duties
Administration
5-2056. The Chief Executive Officer,
subject to the control of the Board of Health Board and to the
direction of the Chief of Health Services, have charge of the Department’s
staff and activities and shall delegate responsibilities to qualified
personnel of the Department as necessary to efficiently carry out the activities
of the Department pursuant to this Ordinance. The Department of the Board of
Health and shall have the following powers and duties:
1. Enforce and observe all applicable
statutes, applicable regulations of the Illinois Department of Public Health,
and this Ordinance, including Rules and Regulations adopted by the Department
state law pertaining to the preservation of the public’s
health;
2. Initiate and carry out, at the
direction of the Board, programs and activities of all kinds not inconsistent
with law that may be deemed necessary or desirable in the promotion and
protection of health and the control of disease or conditions which threaten
the public’s health;
3. Adopt and
eEnforce all rules and regulations regularly adopted, or
those promulgated by the authorities having power to make rules and regulations
concerning the promotion and protection of the public’s health including,
but not limited to, rules and regulations requiring the reporting to the
Department of circumstances defined by the Department which may result in
action by the Department to protect the public’s health; or enforce applicable
rules and regulations promulgated by other authorities having power to make
such rules and regulations;
4. Cooperate
with federal and state health authorities to combat new or evolving public
health threats and, where appropriate, make or adopt public health
proclamations, guidelines, bulletins or health advice published or promoted, in
any form, by federal or state health officials pertaining to the preservation
of the public’s health;
5. Coordinate
the activities of the Department with other County, local, municipal and State
offices to provide a coordinated response for the control of diseases or
conditions which threaten the public’s health;
46. Investigate
the existence of any contagious or infectious diseases and take measures
necessary to investigate the existence and prevent the spread of dangerously
contagious diseases including, but not limited to, directing the performance of
physical examinations and tests, the collection of laboratory specimens, the
administration of vaccines, medications, or other treatments and the
observation and monitoring of persons who may have been exposed to a
dangerously contagious disease;
7. Eenforce
the regulations of the Department this Board of Health and applicable
regulations of the authorities having the power to make such
regulations; State Department of Public Health concerning the same;
58. Determine
when diseases are contagious or epidemic or when a danger to the public’s
health exists and enforce quarantine regulations whenever he deems it
necessary order those measures deemed necessary to protect the public’s
health including, but not limited to, the quarantine or isolation of persons or
closure of places when such action is required to protect the public’s health,
until such time as the condition can be corrected or the danger to the public
health eliminated or reduced in such a manner that no immediate threat to the
public health any longer exists.

69. Make
all necessary sanitary and health investigations and inspections;
610. Investigate
and cause to be abated and cause all nuisances affecting the
public health to be abated with all reasonable promptness according
to in accordance with applicable law, including this Ordinance;

request, give professional advice and information to all city, village,
incorporated town, and school authorities on matters pertaining to sanitation
and public health;
812. For
any suspected violation of this Ordinance or state law, enter any building,
structure or premises, according to law, for the purpose of determining whether
there is a violation of any of the health provisions of this Ordinance or
the health provisions of state law code;
13. Cause
to be confined, and specify the conditions of such confinement, any person who
fails to comply with an order of the Department or the Court or who, in the
judgment of the Department, may not be relied upon to comply with an order of the
Department, where such confinement is necessary to protect the public health.
1014. Cause
to be arrested any person who violates an order of the Department of the
Illinois Department of Public Health. any of the health provisions
established by this Board of Health or of the State Department of Public

15. In
a manner consistent with federal and state requirements, as applicable, during
an occurrence of biological or chemical terrorism or during a declared disaster
which threatens the public's health, request, and at sites designated by the
CCDPH, receive and cause to be distributed pharmaceutical and medical supplies
from the Illinois Pharmaceutical Stockpile, the Strategic National Stockpile
and or any additional sources in order to aid the state and local emergency
response authorities when local resources have been depleted or when the need for
additional resources is reasonably anticipated.
16. During
a declared disaster which threatens the public’s health, take such actions as
may be requested by the President of the Board or his designee in order to
protect the health of the residents of Cook County.
Measures
Ordered by Department
5-207.(a) Issuance of Orders; Court
Petitions. The Department may order measures it deems
necessary to protect the public’s health including, but not limited to, an
order requiring that a person or a group of persons be quarantined or isolated
or that a place be closed and made off limits to the public. Such orders
shall be issued with the consent of the person(s) or owner of the place
affected or upon the prior order of a court of competent jurisdiction. If, in the judgment of the Department,
immediate action is required to protect the public health, the Department may
order, on an immediate basis without prior consent or court order, measures it
deems necessary to protect the public’s health including, but not limited to,
an order requiring that a person or a group of persons be quarantined or
isolated or that a place be closed and made off limits to the public, until
such time as the condition can be corrected or the danger to the public health
eliminated or reduced in such a manner that no immediate threat to the public
health any longer exists. In addition to
other circumstances in which such orders are appropriate, the
Department may order that an individual be quarantined or
isolated in order to prevent the spread of a dangerously communicable disease
when an individual refuses or fails to submit to measures required by the
Department in order to investigate whether a person is or may be infected with
or capable of communicating a dangerously communicable disease. In the event of
an immediate order issued without prior consent or court order, the Department
shall, as soon as practicable thereafter, obtain the consent of the person or
owner or file a petition requesting a court order authorizing the continuation
of the order of the Department. Pending
a court order on the matter, all Department orders shall remain in full force
and effect until lifted by the Department. The County shall make
payment of reasonable attorneys’ fees, if ordered by the Court, with respect to
the representation of indigent persons who object to a Department order.

5-207.(b) Enforcement
of Orders. A health care
provider licensed in
5-207.(c) Regulations. The Department may promulgate
rules and regulations as are reasonable and necessary to implement and
effectuate the provisions of this Section, including rules and regulations
providing for due process protections.

5-20609. That the Cook County Department of
Public Health is hereby authorized to set up a special account in a bank or
depository to be known as “Cook County Department of Public Health-Petty Cash
Account.”
Persons Authorized to Draw on Account
5-20710.
That the Chief Executive Officer Medical Officer,
Business Manager, the Department’s Director of Financial Control and
a Department one of employee acting in a fiduciary
capacity of the Department shall be authorized to sign checks drawn on
the aforementioned “Cook County Department of Public Health-Petty Cash Account”
for payment of petty cash expenses; provided, however, that all checks so drawn
shall be signed by at least two of the three persons so authorized to sign.
Auditing Account
5-20811. That the “Cook County Department
of Public Health-Petty Cash Account” shall be audited at the close of each
fiscal year by the
Home Nursing Visits under
Medicare
5-20912.
The Cook County Department of Public Health is hereby
authorized to coordinate the providing of home nursing visits to suburban under Medicare. (Res.

COLLECTION OF FEES FOR HOME HEALTH SERVICE
Definitions
5-210. Section 1. For the
purpose of this Ordinance, unless the context Otherwise requires:
A. “Department” means the County Health
Department of the County
of Cook.
B. “Board” means the Board of Health of the County
of Cook.
C. “Home Health Agency” or “Agency” means the
health department of the County
of Cook which is
responsible for providing the “Home Health Service” in accordance with the
certification standards established by the Illinois Department of Public
Health.
D “Home Health Service” means those items and
services furnished to individuals, under the care of a physician, on a visiting
basis in a place of residence used as such individuals home. These services are provided by the Home
Health Agency under a plan for furnishing such items and services to an
individual, established and periodically reviewed by the patients physician,
and includes par time or intermittent
nursing care provided by or under the supervision of a registered professional
nurse, and the services of one or more of the following: physical,
occupational, or speech therapy, medical social work, or part time or
intermittent services or a home health aide.

Authorization to Collect Fees
5-211. Section 2.
Pursuant to Section 14 of “An Act in relation to the establishment and
maintenance of county and multiple county public health department, approved July 9, 1943, as amended,”
the Board of Health is authorized to collect fee for services rendered by the
home health agency.
Fee Schedule
5 212. Section 3. The Board of Health has the power to
establish a fee schedule which shall not be more than the actual cost based on
accepted cost accounting methods of rendering home health service and to
collect such fees from those person who receive these services or from public
or private agencies which, pursuant to contract, agree to pay such fees on
behalf of eligible persons.
Gifts and Bequests
5- 213. Section 4.
The Board is authorized to:
A. Accept gift and bequests for the purpose of administering the
home health service program and to expend such gifts and bequests, or invest
such gifts and bequests and expend the income there from, for the maintenance
of such home health services.
B. Deposit all gifts and bequests received
which are not otherwise invested, the income from those gifts and bequests
which are invested, and all fee collected, in the “County Health Fund” to the
credit of the “Home Health Service.”

Search and Certification Fees
5-214. (a) The
Department of Public Health shall charge a fee of $7.00 for any search of the
files of birth, death and fetal death records upon a written request from any
applicant entitled to such search. If,
upon search, the record request is found, the custodian to whom the request was
submitted shall furnish the applicant one certification of such record, or one
certified copy of such record.
(b) A further fee of $2.00 shall be required for

5-215.
Regulations. The Department is authorized to issue rules and
regulations in carrying out its duties under this Ordinance. With the
exception of emergency regulations, all regulations of the Department shall be
submitted to the Board for approval prior to becoming effective. Upon a
determination that the public’s health will be endangered unless immediate
regulatory action is taken, the Chief Executive Officer may adopt and enforce
emergency regulations of the Department which shall remain in effect until the
Board has adopted or rejected the emergency regulations or for a period of
ninety days, whichever is shorter. All regulations adopted by the
Department shall be filed with the

5-216.(a)
Any person who violates the provisions of this Ordinance, or any
regulations promulgated hereunder, or any Department orders authorized under
this Ordinance or under applicable law shall be guilty of a Class B misdemeanor
and shall be subject to arrest and a fine of $1000 for each violation.
(b) In addition to any other remedies permitted under this Ordinance, the Department or the State's Attorney may file a complaint in the Circuit Court of Cook County to enjoin any person from violating the provisions of this Ordinance, or any regulations promulgated hereunder or any Department orders provided for under this Ordinance.

Ordinance as Exercise of Home Rule Authority
5-217. This
Ordinance, as amended from time to time, is promulgated pursuant to the powers
of the County of Cook as a home rule unit of local government under the 1970
Illinois Constitution, Article VII, Section 6, and shall supersede all state
statutes to the extent that it may be in conflict with them, including without
limitation, any of the provisions set forth in 55 ILCS 5/5-25001, et seq., as
amended.
Severability
5-218. Severability. To the extent that any provision of this
Ordinance is determined by a court of competent jurisdiction to be invalid,
such provision shall be severable from the remaining provisions of this
Ordinance which shall continue in full force and effect.
Section 2. Effective Date. The amendments set forth in this ordinance
shall be effective upon adoption by the Board of Commissioners.

Planning and Policy that the monthly cost to operate the Old Cook County
Hospital, the Children’s Hospital, the Main Power House, and the 12 KV Power
House exceeds $400,000; and
WHEREAS, the
Board of Commissioners of Cook County has been advised by other entities that
the County could save a significant amount of this monthly cost by rendering
inoperative and fencing off the Old Cook County Hospital, the Children’s
Hospital, the Main Power House, and the 12 KV Power House.
NOW, THEREFORE, BE IT
ORDAINED RESOLVED, that Cook County will immediately turn off
the gas and electricity to the Old Cook County Hospital, to the Children’s
Hospital, to the Main Power House, and to the 12 KV Power House, and drain the
sprinkler systems and the water pipes in these buildings in order to reduce the
operating costs to the County by as much as 85% of the current monthly
expenditure.

Congratulating the
on the Completion of the
WHEREAS, the
Howard Area Community Center has been an integral part of the Rogers Park
neighborhood since 1967 when it opened its doors to help meet the emergency and
language needs of the neighborhood’s primarily low-income immigrant population;
and
WHEREAS, today,
the
WHEREAS, the
Howard Area Community Center recognizes that the issues faced by many
individuals and families cannot be neatly categorized and resolved with
single-focused programs and so has remained dedicated to being a community
organization that functions as an integrated network providing for a variety of
service and social needs from one location; and
WHEREAS, in its
36 years of serving the community, the Howard Area Community Center has grown
in size and scope to serve more than 5,000 individuals each year through
programs that work with community residents of all ages from infants and
toddlers to the elderly; and

WHEREAS, the
Howard Area Community Center has prioritized early childhood programming as an
essential community service need and to expand their efforts in this area, have
opened a new state-of-the-art Family Center that will house all of its early
childhood programs including a new child care center; and
WHEREAS, the new
facility has been officially named the Sheila Reynolds Berner Family Center in
honor of Mrs. Reynolds Berner who has worked at Howard Area Community Center as
a volunteer for 17 years; and
WHEREAS, Mrs.
Reynolds Berner earned a Masters degree in Social Work from Loyola University
after raising her four children; and
WHEREAS, as a
trained social worker, Sheila Reynolds Berner recognized the importance of and
need for the community based work being undertaken by the Howard Area Community
Center; and
WHEREAS, Sheila
Reynolds Berner stands out as one of the Howard Area Community Center’s most
significant supporters who has contributed her time, professional skills,
resources and financial support for the work of the Center; and
WHEREAS, Sheila
Reynolds Berner has been a tireless advocate for the neighborhood residents she
served and has never waived in her commitment to helping people improve their
lives; and
WHEREAS, the
NOW, THEREFORE, BE IT
RESOLVED, that the Cook County Board of Commissioners does hereby warmly
congratulate the Howard Area Community Center and Sheila Reynolds Berner on the
completion and opening of the Sheila Reynolds Berner Family Center; and

Congratulating the Winnetka Park District on its Centennial Anniversary
WHEREAS, the
Winnetka Park District was founded in 1904 by a group of residents who banded
together to purchase a small parcel of land, known as Station Park, at Elm
Street and Green Bay Road for roughly $8,500; and

WHEREAS, the

Winnetka Park District is the fourth oldest park district in

the hard work and commitment of countless numbers of residents who have served
on the Park District Board and volunteered for the District, and because of the
general support of the community, the Winnetka Park District has grown to
include 28 parks totaling 244 acres; and
WHEREAS, the
Winnetka Park District includes among its facilities three swimming beaches, a
boating beach, Winnetka Ice Arena, A.C. Nielsen Tennis Center, Winnetka Golf
Club, a skate park, and several platform tennis courts; and
WHEREAS,
throughout its 100 year history, the Winnetka Park District has worked to
address the recreational needs of all its residents by always looking toward
the future with an innovative eye; and
WHEREAS, the
Winnetka Park District was the first park district in the State of
WHEREAS, the
Winnetka Park District is recognized as an essential community agency that
provides invaluable services and countless recreational opportunities to the
citizens of
NOW, THEREFORE, BE IT
RESOLVED, that the Cook County Board of Commissioners does hereby
congratulate the Winnetka Park District on its 100th Anniversary and commends
the citizens of Winnetka for their ongoing support of the Park District; and

Congratulating Jesse and
100th Birthdays and 79th Wedding Anniversary
WHEREAS, Jesse
White was born on January 3, 1904 in Chicago’s West Side Austin neighborhood
and upon finishing grade school, went to work at the Chicago Board of Trade;
and
WHEREAS, Selma
Groop, known as Sal to her family and friends, was born on October 6, 1903 in
Crystal Falls, Michigan and as an adventuress young woman, moved to Chicago at
the age of 17 to find work; and

WHEREAS, Jesse
and Sal met while working at Western Electric, had their first date in 1923 at
the Chicago Theater, and were married two years later; and
WHEREAS, as a
young married couple, Jesse and Sal worked together to overcome the many
challenges they faced as a result of the Great Depression including Jesse’s
three month absence traveling to the Alaskan gold fields for work; and
WHEREAS, Jesse
and Sal had their first child, Roger, in 1937 and later welcomed the arrival of
their daughter Pam in 1945; and
WHEREAS, after
living in
WHEREAS, while
both Jesse and Sal worked outside the home, he worked for thirty years at the
Bismarck Hotel in Chicago, and starting in 1953, she worked with the Quickset
Camera Company, they cherished their family life and always made time for each
other; and
WHEREAS, Jesse
and Sal are the proud grandparents of five grandchildren and five
great-grandchildren and they delight in spending time with their grandchildren
who bring them countless moments of joy and love; and
WHEREAS, for the
last eighty-one years, Jesse and Sal have remained true and steadfast in their
love for one another, have always taken time to talk out their problems, and
recognize the importance of compromise in their relationship; and
WHEREAS, Jesse
and Sal are a modern day example of living life to its fullest, both are still
active at age 100, and prove that love can carry you through life’s ups and
downs.
NOW, THEREFORE, BE IT
RESOLVED, that the Cook County Board of Commissioners does hereby
congratulate Jesse and Selma White on their 100th Birthdays and their 79th
Wedding Anniversary; and

DeAngelis was a member of the Illinois General Assembly, where he compiled an

his career as President of Vulcan Tube and Metals Corporation; and

DeAngelis was active in the Italian-American community in Chicago Heights, and
was widely known for his passionate approach to fine Italian cooking; and

DeAngelis has left behind a legacy of accomplishment for his beloved

compassionate leader, virtuous of character and gentle in spirit, possessive of

Women’s Bar Association of Illinois (WBAI) is celebrating its 90th Anniversary

1914, the WBAI has promoted the involvement of women attorneys through business
and professional development and advocacy of women’s interests; and
WHEREAS, the WBAI
was the first professional organization in

WHEREAS, the
WBAI’s earliest efforts to promote the interests and welfare of women revolved
around passage of a constitutional amendment to permit women to vote and
legislation allowing women to serve on juries; and
WHEREAS, the WBAI
serves Cook County voters by evaluating and recommending judicial candidates in
order to promote a court system that is reflective of the diversity of the
legal community; and
WHEREAS, for more
than fifty years, the WBAI newsletter has provided commentary on legal and
legislative developments of particular interest to women attorneys and
publicizing the accomplishments of its members; and
WHEREAS, the
celebration of this milestone raises awareness of the historical significance
that the WBAI organization and individual members have had within both the
legal community and the state at-large.
NOW, THEREFORE, BE IT
RESOLVED, that we, the Cook County Board of Commissioners, gathered here
this 19th day of February 2004, do hereby express our congratulations to the

WHEREAS, MARIA TERESA ALVARADO AVILA passed
from this life on Sunday, February 1, 2004 at the Bayfront Medical Center in
St. Petersburg Beach, Florida; and was waked at Beach Memorial Chapel and
further mourned at her funeral at St. John's Catholic Church, St. Petersburg
Beach, Florida, and was buried at Memorial Park Cemetery, St. Petersburg,
Florida; and
WHEREAS, MARIA TERESA ALVARADO AVILA was born
January 7, 1914, in El Paso, Texas to Marie Prieto and Jose Merced Alvarado
Bernal; and
WHEREAS, MARIA TERESA ALVARADO AVILA's mother,
Marie Prieto, died when she was four years old, and she and her sister, Lala
Alvarado, lived with her paternal Aunts "Panchita" Frances Alvarado
Fernandez, Jovita Alvarado Fernandez, and Ciria Alvarado Sorini; and
WHEREAS, MARIA TERESA ALVARADO AVILA's father,
Jose Merced Alvarado Bernal, with her and her sister, Lala Alvarado, migrated
to Chicago, Illinois when he worked for the New York Central Railroad about
1925-30; and
WHEREAS, MARIA TERESA ALVARADO AVILA stood
only about 4 feet 10 inches tall, she stood at least 10 feet tall or more with
her indomitable spirit in overcoming obstacles; and
WHEREAS, MARIA TERESA ALVARADO AVILA sold
homemade ice cream, sweet potatoes, and paper shopping bags with handles on Maxwell
Street in Chicago during the Depression; worked at the old Nabisco Cookie
Factory formerly located on Polk Street; and helped run Bob's Grocery Store
located near Taylor Street in the Old Italian neighborhood; and

WHEREAS, MARIA TERESA ALVARADO AVILA lived at
1142 South Ashland, Chicago, Illinois among many Chicago addresses the many
years that she resided in Chicago; and
WHEREAS, MARIA TERESA ALVARADO AVILA worked
for the Office of the Clerk of the Circuit Court of Cook County, retired about
1975, and moved to St. Petersburg Beach, Florida; and
WHEREAS, MARIA TERESA ALVARADO AVILA spoke
both English and Spanish and translated for the judges, lawyers, law
enforcement officers, and others in the offices and the Courts of the Circuit
Court of Cook County; therefore, helping many Hispanic immigrants; and
WHEREAS, MARIA TERESA ALVARADO AVILA served as
a Precinct Captain for the 5th Precinct of the 46th Ward when she and her
family lived in the Wrigley section of Lakeview in Chicago; and also worked as
a Precinct Worker in the "Old" (before redistricting) 1st Ward for
about ten years and also worked in the 22nd Ward in Chicago; and
WHEREAS, MARIA TERESA ALVARADO AVILA lived to
see her son, Manuel Frank Avila, who walked the precincts with her to get out
the votes, when he was elected and installed as Commissioner of the Water
Reclamation District of Great Chicago; and
WHEREAS,
MARIA TERESA ALVARADO AVILA enjoyed animals and particularly her dogs
including her boxer King whose ashes were buried with her and a smaller dog,
Chewie who lived with her to her death; and, her grandson Ricky’s dog, Bart,
who ended up with her when Ricky went to Afghanistan; and
WHEREAS,
MARIA TERESA ALVARADO AVILA enjoyed traveling, particularly on a trip to
Spain for her 80th Birthday; an Odyssey to El Paso, Texas to reunite with her
Alvarado cousins; trips to visit her various grandchildren scattered throughout
the USA and cruises to Costa Rica and Alaska; and
WHEREAS,
MARIA TERESA ALVARADO AVILA married Francisco M. Parocua Avila in 1936 in
WHEREAS,
MARIA TERESA ALVARADO AVILA was the loving and devoted matriarch of the
Alvarado-Avila family and a single parent to her loving children including
Manuel Frank Avila, Mary Theresa Avila Pabon, Richard Avila and Daniel
Avila. At one time Teresa helped raise
her three step sons, Russell Metzger Avila, Richard Frank Metzger Avila and
Robert Metzger Avila; and
WHEREAS,
MARIA TERESA ALVARADO AVILA valued education and strongly encouraged and
supported her children and grandchildren to attend college and continue to
further their education even though she only had an elementary education; and
WHEREAS,
MARIA TERESA ALVARADO AVILA took her family on numerous field trips to the
various museums, zoos and parks; and
WHEREAS,
MARIA TERESA ALVARADO AVILA leaves behind to mourn her eight precious and
loved grandchildren: Anthony Pabon, Rick Higgins Avila serving in the Marines
in Afghanistan; Frank B. Avila, serving in the U.S. Army Reserves, Chicago;
Quinn Avila, Audrey Avila, Dan Avila, Sr., Brandi Avila Valdez and Robert
Avila, serving in the Navy in Korea. She was also blessed with eight step grandchildren:
Aimee Metzger Avila, James Metzger Avila, Penny Metzger Avila Peng, Russell
Metzger Avila, Jr., Twins Ricky and Roger Metzger Avila, Elena Metzger Avila
Strom in North Carolina and Elena’s twin Rick Metzger Avila, Jr.; and
WHEREAS,
MARIA TERESA ALVARADO AVILA was blessed by the births of five great
grandchildren: Daniel Justin “DJ” Avila, (Step) Ashley Marie Faltrum, Alexandra
Pabon, Danielle Pabon, Alexandra “Alli” Valdez, and three step-great
grandchildren James Avila, Natalie Strom and Colby Avila; and
WHEREAS,
MARIA TERESA ALVARADO AVILA leaves behind her beloved sister, Lala Alvarado
Carvajal, to mourn her; and

WHEREAS, countless people mourn the passing of
this wonderful lady who lived a very full life sometimes working two or more
jobs at a time, giving freely of her time and energy to her family, friends,

clothing, furniture, Christmas baskets and other needs for them.
NOW,
THEREFORE, BE IT RESOLVED, that the Cook County Board of Commissioners and
all who knew her extend condolences to the family of MARIA TERESA ALVARADO AVILA; and

Phillip Bianco, Jr. is a man of high integrity, loving husband, father and
grandfather; and
WHEREAS,
Phillip Bianco, Jr. has multiple interests including gardening and a love of
cars; and

WHEREAS, this
Honorable Body takes great pride in recognizing those members of the community
who work to advance progress, now be it resolved that the President and Cook
County Board of Commissioners wish to extend their thanks to Phillip Bianco,
Jr. for his dedication and leadership amongst his peers and citizens striving
to be a continuous credit to his jobs, family, friends and community and
extending a happy 65th birthday wish along with congratulations on his
retirement from Cook County; and
BE IT FURTHER RESOLVED, that this text be spread upon the official proceedings of this Honorable
Body, and an official copy be tendered to Phillip Bianco, Jr.
